Rights of the Disabled in Turkey’s Accession Process to the European Union
Bahar Yeşim Deniz HabibiThe aim of this study is to reflect on the rights of the disabled in Turkey as they relate to the country’s accession process to the European Union (EU), based on essential legal and reference texts relevant to the topic. Various problems exist concerning the rights of the disabled globally, and this matter needs to be considered within a multidimensional, interdisciplinary framework. The research methodology of this study is to analyze relevant legal and reference texts. In Turkey’s accession process to the EU, realization of the rights of the disabled in terms of implementation must be examined on the basis of the “Copenhagen Political Criteria,” the focus of which is on ensuring human rights, and the United Nations Convention on the Rights of Persons with Disabilities, to which both the EU and Turkey are parties. Focusing on the rights of the disabled, this study emphasizes these dimensions in particular; the topic is examined in light of both European Union Law and “Turkey-European Union Relationship Law.” Assessments and results are presented in this vein.
Türkiye’nin Avrupa Birliği’ne Katılım Sürecinde Engelli Hakları
Bahar Yeşim Deniz HabibiÇalışmanın kapsamı, Türkiye’nin Avrupa Birliği (AB) katılım sürecinde engelli haklarının sağlanması açısından durumunu, konu hakkındaki temel hukuki ve referans metinlerini esas alarak yansıtmaktır. Engelli haklarına ilişkin olarak tüm dünya ölçeğinde çeşitli sorunlar bulunmaktadır; konu, çok boyutlu olarak, interdisipliner bakış açısıyla ele alınmalıdır. Çalışmada araştırma yöntemi ve tekniği anlamında ilgili hukuki ve referans metinlerine yer verilmiştir. Türkiye’nin AB’ye katılım sürecinde, engelli haklarının uygulamada gerçekleştirilmesi, temel perspektifi, insan haklarının sağlanması olan “Kopenhag Siyasi Kriterleri” ve AB’nin de Türkiye’nin de taraf olduğu Birleşmiş Milletler Engelli Hakları Sözleşmesi kapsamında incelenmelidir. Çalışmada, engelli hakları odak alınarak, özellikle bu boyutlara vurgu yapılmakta; konu, gerek Avrupa Birliği Hukuku, gerek “Türkiye-Avrupa Birliği İlişkileri Hukuku” ışığında incelenmektedir. Bu kapsamda, konuyla ilgili değerlendirmeler yapılmakta ve sonuçlara ulaşılmaktadır.
