Timeshare and Long- Term Holiday Product Contracts

Protection of consumers, in timeshare contracts and long-term holiday products, has been regulated under Art. 50 of the Consumer Protection Act numbered 6502 and the Regulation on Timeshare and Long-Term Holiday Product Contracts under Turkish law. Directive 2008/122/EC of the European Parliament and of the Council of 14 January 2009 on the Protection of Consumers in respect of Certain Aspects of Timeshare, Long-Term Holiday Product, Resale and Exchange Contracts forms the basis of the relevant Turkish legislation. This study aims to introduce both systems and evaluate whether Turkish law is in harmony with the EU legislation. Within this respect, definitions and principal consumer protection mechanisms, have been provided under EU and Turkish laws, have been examined respectively in the first and second chapters. The last chapter will compare the two legal systems and provide suggestions.

Devre Tatil ve Uzun Süreli Tatil Hizmeti Sözleşmeleri

Türk Hukukunda devre tatil ve uzun süreli tatil hizmeti sözleşmelerinde tüketicinin korunmasına ilişkin düzenlemeler 6502 sayılı Tüketicinin Korunması Hakkında Kanun m. 50 ve Devre Tatil ve Uzun Süreli Tatil Hizmeti Sözleşmeleri Yönetmeliği’nde yer almaktadır. Düzenlemelerin temelini, Avrupa Parlamentosu ve Konseyin 14 Ocak 2009 tarih ve 2008/122/AT sayılı Devre Tatil, Uzun Süreli Tatil Ürünü, Yeniden Satım ve Değişim Sözleşmelerinin Belirli Yönleri Açısından Tüketicinin Korunması Hakkında Yönergesi oluşturmaktadır. Bu çalışmanın amacı her iki düzenlemeyi de tanıtarak Türk hukukundaki düzenlemelerin, temelini oluşturan AB mevzuatı ile uyumlu olup olmadığını değerlendirmektir. Bu çerçevede, çalışmanın ilk bölümünde AB mevzuatı, ikinci bölümünde ise Türk mevzuatındaki tanımlar ve öngörülen başlıca korumalar incelenecek, son bölümde ise her iki hukuk sistemindeki düzenlemeler karşılaştırılarak önerilerde bulunulacaktır.
