On the Conditions of Formation of John Rawls' Idea of Justice

Justice is imperative for the functioning of this structure. For Rawls, ensuring the fairness of society is seen as the main goal. It is possible to see Kant’s influence in the foundations of Rawls’s idea of justice. Rawls' idea of justice is about inclusive reasoning. During his formation of the idea of justice, Rawls uses concepts such as the original position, the veil of ignorance, the principles of justice, overlapping consensus. Along with these concepts, Rawls' point of view on justice is based on a theoretical basis. The idea of justice formed within the framework of this foundation creates a valid order for all individuals. The order is formed by the determinants Rawls put forward and the individuals in the society. Rawls' idea of justice becomes concrete with the principles of justice. The principles of justice have an inclusiveness that applies to individuals and allows equal opportunities for all. Rawls wants to determine the terms of justice from the very beginning and prevent possible future problems. Rawls wants to ensure political justice after the establishment of society In the context of the formation of the idea of justice, the overlapping consensus and justice as fairness emerge here. In this text, an attempt is made to put forward the main pillars of Rawls's theory of justice.
John Rawls'un Adalet Düşüncesinin Oluşum Şartları Üzerine
Müfit Mert BağderJohn Rawls'a göre adalet kavramı toplumla doğrudan ilgilidir. Toplum adalet kavramı olmadan doğru kurulabilecek bir yapı değildir. Bu yapının işleyişi için adalet bir zorunluluk taşımaktadır. Rawls için toplum durumunun adil olmasını sağlamak ana hedef olarak görülür. Rawls’un adalet düşüncesinin temellerinde Kant etkisini görmek mümkündür. Kant ilkesel olarak Rawls’a bir yol gösterici olarak görülür. Rawls'un adalet düşüncesi kapsayıcı bir akıl yürütme üzerinedir. Rawls adalet düşüncesinin oluşumu sırasında başlangıç durumu, bilgisizlik peçesi, adalet ilkeleri, örtüşen görüşbirliği gibi kavramlardan yararlanır. Bu kavramlarla beraber Rawls'un adalete bakış açısı teorik bir temele dayanır. Bu temel çerçevesinde oluşan adalet düşüncesi, bütün bireyler için geçerli bir düzen oluşturur. Düzen Rawls’un ortaya koyduğu belirleyiciler ve toplum içerisindeki bireyler tarafından oluşturur. Rawls bu anlamda adalete, toplum sözleşmesine benzer bir bakış açısıyla yaklaşmıştır. Rawls'un adalet düşüncesi adalet ilkeleriyle somut hale gelir. Adalet ilkeleri, bireyler için geçerli ve herkese eşit fırsatlar tanıyan bir kapsayıcılığa sahiptir. Rawls en baştan adaletin şartlarını belirleyerek ilerisi için oluşması muhtemel sorunların da önüne geçmek istemektedir. Rawls toplumun kuruluşundan sonra siyasal adaleti sağlamak istemektedir. Adalet düşüncesinin oluşumu bağlamında örtüşen görüşbirliği ve hakkaniyet olarak adalet burada ortaya çıkar. Bu metinde Rawls'un adalet teorisinin ana dayanakları ortaya konulmaya çalışılmıştır. Bu çerçevede adalet düşüncesinin oluşum şartları incelenmektedir. Son bölümde de adalet ilkelerinin problemleri ve Habermas’ın eleştirileri tartışılmaktadır.
