New Payment Services in Banking Law and Activities Excluded from the Payment Services Regime

It is vital for the functioning of the payment services market to ensure that the payment services can appeal to a wide audience, as well as being sustained in an environment that is safe and consumers are legally protected within, while complementing innovative technological infrastructure. In order to ensure functionality of this mechanism, the new Payment Services Directive has entered into force, which provides number of innovations in European Union law that have various aspects, such as payment service types, data security, authentication, activity permit and registration requirement, activities that are excluded from the payment service regime and the supervisory powers of administrative authorities. In this study, the situation in Turkish legislation has been discussed after the brief introduction of novelties that have been introduced in European Union law to create a general perspective on this issue, as well as both legal systems have been compared with the main lines and proposals for changes that have been considered to be useful for Turkish legislation have been set forth at the first glance.

Bankacılık Hukukunda Yeni Ödeme Hizmetleri ve Ödeme Hizmetleri Rejiminden İstisna Edilen Bazı Faaliyetler

Ödeme hizmetlerinin geniş kitlelere hitap edebilmesi kadar yenilikçi teknolojik altyapıyı tamamlayacak şekilde güvenli ve tüketicilerin hukuken himaye edildiği bir mekanizma içerisinde sürdürülebilmesi, ödeme hizmetleri piyasasının işleyişi açısından hayati öneme sahiptir. Bu mekanizmanın sağlanabilmesi gayesine matuf olmak üzere, Avrupa Birliği hukukunda reform niteliğinde bir dizi yenilik öngören yeni Ödeme Hizmetleri Yönergesi yürürlüğe girmiştir. Anılan yeniliklerin; ödeme hizmeti türleri, veri güvenliği, kimlik doğrulama, faaliyet izni ve tescil yükümlülüğü, ödeme hizmeti rejiminden istisna tutulan faaliyetler ve idari otoritelerin gözetim ve denetim yetkileri şeklinde muhtelif cepheleri bulunmaktadır. İşte bu çalışmada konuya ilişkin genel bir bakış açısı oluşturabilmek amacıyla Avrupa Birliği hukukunda öngörülen yeniliklerin kısa bir tanıtımının yapılmasını takiben Türk mevzuatındaki durum ele alınmakta ve her iki hukuk sistemi ana hatlarıyla mukayese edilerek, Türk mevzuatında ilk etapta yapılmasında fayda bulunduğu değerlendirilen değişiklik önerilerine yer verilmektedir.
