Misleading and Comparative Advertisements

Effects of advertising campaigns usually reach out to all EU, and even the entire world, although theyare carried out in several countries. Thus, the approximation of laws relating to “advertising” in member states has particular importance in the EU. The primary goal of the Directive 2006/114, which is the current law on the subject, is to protect the interests of traders but the interests of consumers is indirectly shielded as well. The purpose of the Directive is to protect traders against the misleading advertising and unfair impacts of it and to detect the circumstances in which comparative advertising is allowed. The Directive stipulates “misleading advertisements” and “comparative advertisements” that sets out the objective minimum of criteria for the determination of whether or not an advertisement has been misleading and indicates under what conditions comparative advertisement is permitted.

Yanıltıcı ve Karşılaştırmalı Reklamlar

Reklam kampanyaları sadece belirli ülkeler ile sınırlı olarak yürütülse dahi, etkilerini hemen her zaman tüm Avrupa Birliği ülkelerinde ve hatta tüm dünyada gösterebilmektedir. Bu itibarla üye devletlerin “reklam”a ilişkin normlarının uyumlaştırılmasına özel önem atfedilmiştir. Hâlihazırda öncelikli amacı işletme sahiplerinin (traders) menfaatlerinin korunması olan, ancak dolaylı olarak tüketicilerin menfaatlerinin de korunduğu 2006/114 sayılı Yönerge yürürlüktedir. Yönerge’nin amacı işletme sahiplerinin yanıltıcı reklamlara ve haksız sonuçlarına karşı korumak ve karşılaştırmalı reklama hangi şartlar dâhilinde izin verileceğini tespit etmektir. Yönerge’de “yanıltıcı reklamlar” ile “karşılaştırmalı reklamlar” düzenlenmiş, bir reklamın “yanıltıcı” olup olmadığını tespit bakımından objektif asgari kriterler tespit edilmiş ve “karşılaştırmalı reklama” hangi şartlar dâhilinde izin verileceği gösterilmiştir.
