Child Protection Administration on The East-West Axis Country Examples
Memduh Cemil ŞirinDifferent administrative models have been developed for children in need of protection. Child protection administration can be examined through three main elements: The position of child protection activities in the administrative organisation of the state, the relationship between the administration and the judiciary, and the role of private law entities. In this study, the child protection administrations of England, India, Egypt, France and Türkiye are examined in the context of these three elements. The review was carried out within the basic legislative acts for children in need of protection in each country. In these countries, different models have been adopted in which the central or local authorities come to the fore, the child is taken under protection by an administrative and/or a judicial decision, and the children who are taken into care are placed in foster families in institutions run by private persons.
Doğu Batı Ekseninde Çocuk Koruma İdaresi Ülke Örnekleri
Memduh Cemil ŞirinKorunmaya ihtiyacı olan çocuklara yönelik farklı idari modeller geliştirilmiştir. Çocuk koruma idaresi üç temel unsur üzerinden incelenebilir: Çocuk koruma faaliyetlerinin devletin idari teşkilatı içerisindeki konumu, idare ile yargı arasındaki ilişki ve özel hukuk kişilerinin rolü. Bu çalışmada İngiltere, Hindistan, Mısır, Fransa ve Türkiye’nin çocuk koruma idareleri bu üç unsur bağlamında incelenmiştir. İnceleme, her bir ülkede korunmaya ihtiyacı olan çocuklara yönelik temel mevzuat hükümleri çerçevesinde yapılmıştır. Bu ülkelerde merkezi idare veya yerel yönetimlerin öne çıktığı, çocuğun idari karar ile koruma altına alındığı ve/veya yargı kararının arandığı, bakım altına alınan çocukların koruyucu aile yanına, özel hukuk kişileri tarafından işletilen kurumlara yerleştirildiği farklı modeller benimsenmiştir.
