The Most Prevalent Form of Orphanhood: Social Orphans and Juvenile Delinquency
Oğuzhan EyilikWhile the concept of an orphan, which means being alone, is expressed as a child whose father has died in Islamic literature, in today’s legal system and social life, it refers to a child without a mother or father. Many verses in the Qur’an include the guidelines of Islam regarding the protection of values and rights given to orphans. When we read the protective and conscientious rulings in Islam regarding caring for orphan children, we should think beyond the meanings that first come to mind. There are protective and caring parents for children whose duty is to protect the child’s life, rights and future. When the child becomes an orphan, this responsibility is transferred from the parent to the relatives of the orphan and the society.

Oğuzhan EyilikYalnız olmak, tek başına kalmak anlamlarına gelen yetim kavramı ile, İslami literatürde babası ölmüş çocuk ifade edilir iken günümüz hukuk sisteminde ve sosyal yaşamında ise anne ya da babasını kaybetmiş çocuk kast edilir. Yetimlere verilen değer ve hakların korunmasına ilişkin İslam’ın emirlerini içeren pek çok Kur’an ayeti vardır. Yetim çocukların korunmasına dönük İslam inancının koruyucu ve gözetici emirlerini okuduğumuzda zihnimizde ilk uyanan anlamların ötesini düşünmeliyiz. Çocuklar için koruyucu ve gözetici aileleri vardır, çocuğun yaşamını, haklarını, geleceğini korumak onların üzerine vazifedir. Çocuk yetim durumuna düştüğünde ise sorumluluk yetimin yakınlarına ve topluma düşmektedir.
