The Name of Non-resolution: “Kashmir Despite the United Nations”

The problem of Kashmir continues to be the most important dispute between India and Pakistan. These two nuclear states are responsible for a situation that has been ongoing for 70 years: hundreds of people lose their lives every year, suicide attacks frequently occur, state forces apply disproportionate interventions, and the community is oppressed. The UN Security Council, which is primarily responsible for protecting international peace and security, adopted Resolution (47) during its first years of existence. This resolution provides detailed content for direct resolution of the Kashmir problem. For example, the resolution includes the plan for Kashmir to first be cleared of the military, and then the final situation of Jammu-Kashmir should be determined on the basis of the plebiscite application under UN supervision. Unfortunately, despite the plan, the resolution was not implemented due to disruptions in the UN system.

Çözümsüzlüğün Adı: ‘Birleşmiş Milletler’e Rağmen Keşmir’

Keşmir, Hindistan ve Pakistan arasındaki en belirgin uyuşmazlık konusu olarak varlığını sürdürmektedir. İki nükleer devlet arasında 70 yıldır devam eden Keşmir sorunu, uluslararası toplumu; her yıl yüzlerce kişinin hayatını kaybettiği, intihar saldırılarının gerçekleştiği, devlet güçlerinin orantısız müdahalelerde bulunduğu ve halkın baskı altında tutulduğu bir tablo ile karşı karşıya bırakmaktadır. Esasen, uluslararası barış ve güvenliğin korunması açısından birincil derecede sorumlu olan Birleşmiş Milletler (BM) Güvenlik Konseyi, sorunun ortaya çıktığı ilk yıllarda, doğrudan çözüme yönelik, oldukça detaylı bir içeriğe sahip olan (47) sayılı kararı almıştır. Bu kararda, Keşmir’in öncelikle askerden arındırılması, ardından JammuKeşmir’in nihai durumunun BM gözetiminde yapılacak plebisit uygulaması neticesinde belirlenmesi öngörülmüştür. BM sistemindeki aksaklıklar nedeniyle, kararın uygulanması mümkün olmamıştır.
