27 May Restitution Project: Law of Measures (1962)
The Law on the Laws of Constitutional Law, the National Security and Activities (The Law on Measures) is a project which was prepared by the government after the failed coup attempt of Talat Aydemir on 5 March 1962 and aimed to protect the gains of the May 27 movement. As a result of the decision of the National Unity Committee, elections were decided and a new constitution was prepared. According to the previous constitution, the 1961 Constitution, which was prepared to give more importance to the rights and freedoms of the people, came into force after the referendum and after the elections İsmet İnönü had formed the coalition government. The government’s efforts to create public opinion on the release of former DP members by the pressure of radical parliamentarians on the grassroots side of the government were criticized by the military, and it was believed that civilian life began early. Acting with this idea, Talat Aydemir attempted to strike in Ankara on February 22, 1962, but the army did not reach its goal because it supported the government in general. After this event, the government had prepared a law proposal aimed at prohibiting broadcasting and speech to recall or praise the former DP period in order to avoid similar events. So also it would attempt to prevent the propaganda that could not make Turkey a successful democracy. This regulation, known as the Law on Measures in the Public, was expected to provide the government with a peace of mind for the country’s reforms needed. However, this desire of the government has not been realized with the criticisms of a new Takrir-i Sükûn Law and the issues of coup, amnesty and peace in the media and in the media continued to be discussed. The claims of unlawful and partisan practice in the time of the law in force, will always demanded to be removed in some speeches made by the Assembly of the National Assembly. It was also said that the law was against the articles regulating the freedom of expression of the Constitution, but the high court rejected the applications. The Law of Measures was to be abolished in 1969 under the auspices of the Justice Party in the National Assembly and in the Republican Senate without further objection.
27 Mayıs’ı Restore Etme Projesi: Tedbirler Kanunu (1962)
Anayasa Nizamını, Milli Güvenlik ve Huzuru Bozan Bazı Fiiller Hakkında Kanun (Tedbirler Kanunu), 5 Mart 1962 tarihinde Talat Aydemir’in başarısız darbe teşebbüsünden sonra hükümetin hazırladığı ve 27 Mayıs hareketinin kazanımlarını korumayı amaçlayan bir projedir. Milli Birlik Komitesinin verdiği karar neticesinde seçimlerin yapılmasına karar verilmiş ve yeni bir anayasa hazırlanmıştı. Önceki anayasaya göre kişi hak ve hürriyetlerine daha fazla önem verecek şekilde hazırlanan 1961 Anayasası referandumdan sonra yürürlüğe girmiş, seçimlerden sonra ise İsmet İnönü koalisyon hükümetini kurmuştu. Hükümetin bir kanadını oluşturan Adalet Partisinin radikal milletvekillerinin tabandan aldıkları baskıyla eski DP’lerin serbest bırakılmaları konusunda yaptıkları kamuoyu oluşturma çabaları ordudaki bazı cuntalar tarafından eleştirilmekte, sivil hayatın erken başladığına inanılmaktaydı. Bu düşünce ile harekete geçen Talat Aydemir Ankara’da 22 Şubat 1962’de darbe yapmaya kalkışmış ancak ordunun genel itibariyle hükümeti desteklemesi nedeniyle amacına ulaşamamıştı. Hükümet bu olaydan sonra benzer hadiseleri yaşamamak için eski DP dönemi hatırlatacak veya övecek mahiyette yayın ve konuşma yapmayı yasaklamayı amaçlayan bir kanun teklifi hazırlamıştı. Böylece Türkiye’de demokrasinin başarılı olamayacağına dair yapılan propagandanın da önüne geçilmeye çalışılacaktı. Kamuoyunda Tedbirler Kanunu olarak tanınan bu düzenleme ile hükümete ülkenin ihtiyaç duyacağı reformları gerçekleştirmesi için bir huzur ortamı sağlaması beklenmekteydi. Fakat yeni bir “Takrir-i Sükûn Kanunu” eleştirileriyle karşılan hükümetin bu arzusu gerçekleşmemiş, gerek siyasette gerek basında darbe, af ve huzur konuları tartışılmaya devam etmişti. Kanunun yürürlükte olduğu dönemde “adaletsiz ve partizanca uygulandığı” iddiaları hep söylenecek ve Millet Meclisi kürsüsünden yapılan bazı konuşmalarda kaldırılması talep edilecekti. Ayrıca ilgili kanunun Anayasa’nın ifade hürriyetini düzenleyen maddelerine aykırı olduğu söylenmiş ancak yüksek mahkeme yapılan başvuruları reddetmişti. Tedbirler Kanunu 1969 yılında Adalet Partisi iktidarında Millet Meclisinde ve Cumhuriyet Senatosunda fazla itiraza uğramadan kaldırılacaktı.
