Engelli Hakları Hareketi’nin Hukukî Kazanımları

Engelli Hakları Hareketi, zamanında çocukluk dönemindeki engelliliğin artı-eksilerini yaşayan yetişkin engelliler ile engelli çocuğa sahip ailelerin deneyimleri üzerinde temellenmektedir. Bu yönüyle Engelli Hakları Hareketi, Batı formasyonunda tabandan gelen kitlesel bir sivil haklar hareketidir. Çünkü günümüzde ulusal ve uluslararası ölçekte yasal hak savunuculuğu ve bilimsel çalışmalara öncülük eden bazı sivil toplum kuruluşları esasında engelli bireyler ve onların ailelerinin çabalarıyla dernek düzeyinde kurulan sivil haklar faaliyetlerinin bir ürünüdür. Sivil toplum anlayışının çürümesi anlamına gelen siyasete angaje olma tehlikesine düşmeyen ve engelli haklarını savunmanın temel misyonları olduğunu unutmayan bu sivil toplum kuruluşları günümüze kadar büyüyerek gelmişlerdir. Engelli Hakları Hareketi, özel eğitim alanındaki normalleştirme ve kaynaştırma çağrısı dâhil bilinen neredeyse tüm kazanımlara kaynaklık etmiştir. Dolayısıyla bir devletin Engelli Hakları Hareketi’nin toplumsal mirasına sahip olup olmaması özel eğitim alanındaki reformlar dâhil engelli haklarının gelebileceği nokta konusunda belirleyicidir. Türkiye’yi de bu çerçevede anlamak gerekir. Bu çalışmanın amacı, günümüz özel eğitim anlayışına kaynak oluşturan Engelli Hakları Hareketi ve bunun bir yansıması olan engelli haklarıyla ilgili sembol davalar hakkında bilgi vermektir. Bu çalışmada, Engelli Hakları Hareketi’nin ve bireysel davaların günümüz özel eğitimine yansımalarının aktarılması amaçlanmıştır.

The Legal Outcomes of the Disability Rights Movement

The Disability Rights Movement is based on the experiences of adults with disabilities who have experienced the pros and cons of childhood disability and families of children with disabilities. In this respect, Disability Rights Movement is a mass civil rights movement from the grassroots in the Western formation. Because today, some non-governmental organizations that pioneer legal rights advocacy and scientific studies on a national and international scale are actually the product of civil rights activities established at the level of associations with the efforts of individuals with disabilities and their families. These non-governmental organizations have grown today. Because those did not fall into the danger of being engaged in politics meaning the decay of the understanding of civil society and did not forget that they have the primary mission of defending the rights of the person with disabilities. The Disability Rights Movement has been the source of almost all the achievements we know, including the call for normalization and integration in special education. Therefore, the fact that a country whether has the social heritage of the Disability Rights Movement decisive for the point at which the rights of the disabled can reach, including the reforms in the field of special education. Türkiye has to be understood in this framework as well. The purpose of this study is to give information about the Disability Rights Movement, which is a source for today's special education understanding, and the symbolic cases (lawsuits) related to disability rights, which is a reflection of it. In this study, the reflections of the Disability Rights Movement and related individual cases on today's special education have been tried to be conveyed. In this study, it is aimed to convey the reflections of the Disability Rights Movement and individual cases on today's special education.
