During the continuation of the employment contract, regardless of the reason for the death of the employee, the employment contract between the parties loses its legal existence. The effect of the death of the employee on the employment contract is clearly stated in Article 338/1 of the SCO and Article 440 of the TCO, which is regulated on the basis of this provision. The employment contract terminates automatically upon the death of the employee, and for this result to arise, it is not necessary for the legal heirs left behind by the employee or the employer to give a notice of termination after the death of the employee. The acceptance of the termination of the employment contract upon the death of the employee in the legal regulations is a natural consequence of the fact that the employee is obliged to personally perform the work undertaken during his/her lifetime.Neither Labour Law No. 4857 nor Maritime Labour Law No. 854 stipulates that the employer shall make a payment to the survivors of the deceased employee following the automatic termination of the employment contract upon the death of the employee. However, Article 18 of the Press Labour Law, titled death indemnity, stipulates that “In the event of termination of the employment contract due to the death of the journalist, his/her spouse and children, and in their absence, the members&nbsp;of his/her family whose livelihood depends on him/her, shall receive death indemnity in the amount of seniority rights, not less than three times the monthly wage of the deceased”. While this is the case in terms of Turkish Law, the regulation in Article 338/2 of the Swiss Code of Obligations has been translated and transferred to Article 440 of the Turkish Code of Obligations, and a regulation similar to the death indemnity in the Press Labour Law has been introduced. According to Article 338/2 of the Swiss Code of Obligations, “However, the employer is obliged to pay wages to the deceased employee’s spouse, registered union, minor children and, in the absence of these heirs, to other dependent survivors for an additional month calculated as of the day of death, or for an additional two months in the case of five years of seniority”. According to the second sentence of Article 440/1 of the Turkish Code of Obligations, “The employer is obliged to pay one month’s wage to the surviving spouse and minor children of the deceased employee, or in the absence of such heirs, to the dependents of the deceased employee, starting from the day of death, or two months’ wage if the service relationship has continued for more than five years.”The right to demand payment from the employer is not a right arising from the estate of the deceased employee and passing to the heirs according to the principles of inheritance. This right arises directly for the surviving beneficiaries mentioned separately in each article. Therefore, even if the inheritance is rejected, the right to claim payment does not disappear, as the right is originally recognised to the persons concerned.To be entitled to payment, it is necessary to be a beneficiary who are foreseen to claim payment at the time of death. The surviving spouse and minor children of the deceased worker, or if these are not available, the persons who were dependent on the worker in his/her lifetime, shall be entitled to the payment. According to Article 338/2 of the SCO, with the surviving spouse, the registered union of the deceased worker is also listed as the beneficiary. For the beneficiaries to be entitled to the payment, the employment contract concluded between the employee and the employer must be a valid contract and the employee must have started to work in accordance with the contract. To be entitled to the payment, the seniority period of the worker before the date of death is not of any importance. In the payment to be made by the employer to the surviving beneficiaries due to the death of the worker, the seniority period is taken into consideration in determining the amount entitled, not in entitlement to payment. In this framework, if the seniority period at the date of the death of the worker is five years or less, the amount of payment that can be requested is the amount of one month’s wage of the worker. On the other hand, if the seniority period at the date of the worker’s death exceeds five years, the amount of payment to be paid is two months’ salary.There is no clarity as to how the payment amount will be divided among more than one beneficiary at the same time. The predominant view adopted in Turkish and Swiss law is that the payment amount should be divided equally. The minority&nbsp;opinion, on the other hand, accepts that the distribution should be made according to the inheritance shares. In the decision of Antalya RCA 9th Civil Chamber dated 03/05/2020 and numbered 2019/2696 E. and 2020/657 K., which is the first decision regarding the application of the regulation on death compensation under Article 440 of the TCO, it was concluded that death compensation should be divided among the persons entitled to death compensation in proportion to their inheritance shares specified in the certificate of inheritance.Since there is no separate interest rate determined for the payment to be made by the employer to the surviving beneficiaries due to the death of the employee, legal interest should be applied. The automatic termination of the employment contract upon the death of the employee causes the receivable regarding the payment to be made by the employer to the right holders left behind due to the death to become due, but the default of the employer does not arise simultaneously and automatically with the receivable becoming due. There is no clarity in both Art. 338/2 of the SCO and Art. 440 of the TCO that the payment must be made to the persons determined as beneficiaries on the date of death. For this reason, although the decision of the 9th Civil Chamber of Antalya RCA is correct in determining that legal interest should be applied in death compensation, it is not correct to run the interest from the date of death without requiring the employer to be in default.Within the framework of the current legal regulations, the statute of limitations for death compensation should be accepted as 10 years from the date of death of the worker.The provisions regarding the payment to be made by the employer to the beneficiaries left behind due to the death of the employee are of a relative mandatory nature. For this reason, it is possible to make arrangements that make the right better than the legal regulation, for example, extending the duration of the payment or expanding the scope of the persons who will benefit from the payment.In the doctrine of labour law, the debate focuses on whether the provision on death indemnity stipulated in Article 440 of the TCO can be applied to workers subject to the Labour Law and seafarers subject to the Maritime Labour Law, other than to workers subject to the Turkish Code of Obligations. Although there are different opinions on the subject, it is more appropriate to accept that the provision is applicable only to workers subject to the provisions of the Turkish Code of Obligations. In the decision of the 9th Civil Chamber of Antalya RCA dated 03/05/2020 and numbered 2019/2696 E. and 2020/657 K., it was concluded that workers subject to the Labour Law and seafarers subject to the Maritime Labour Law may also claim death indemnity stipulated in Article 440 of the TCO, and that there is no obstacle to request death indemnity together with severance pay.

During human history, there have been many conflicts during which civilians from various regions of the world have suffered from violent acts. There have been attempts to codify a group of unlawful acts as international crimes beyond the nation state level. During this process, certain unlawful acts were deemed to be in keeping with the spirit of war, while the most violent ones were considered infractions that affected the conscience of all humanity. These efforts began at the end of the 19th century, with international conventions on the limitations of warfare methods and the impact of war on civilians. The 20th century witnessed two world wars and an important number of intrastate conflicts. The striking dimension of these conflicts has pushed the international community to take a step beyond international conventions to punish criminals and prevent the recurrence of new violence against civilians.To take a step further in terms of the application of international conventions, after the outbreak of the First and Second World Wars, the need to establish judicial institutions with international competence has been discussed. With the establishment of these tribunals, definitions of crimes would have been added to their constituent texts, a step would have been taken towards codifying unlawful acts, and the universalisation of criminal justice would have begun. Major developments in this field began with the Second World War. The first examples of ad hoc criminal tribunals were founded in Germany and Japan to prosecute military and political figures responsible for the suffering of civilians. Thanks to these two tribunals, serious breaches of the fundamental rights of individuals have been codified as international crimes, and international criminal law has begun to universalise. Although limited, individuals gained legal personality before international law and became subjects of it. Hence, the legal sphere of Kantian cosmopolitanism has begun to find its place in the international order.&nbsp;The International Military Tribunals of Nuremberg and the Far East have contributed significantly to international criminal law. They form the first proof of the will of the international community to do something beyond international conventions regarding the suffering of civilians during conflicts and thus establish a more binding legal framework. They constitute a via-media between state-centric treaties and a permanent cosmopolitan legal institution. Despite many criticisms, these tribunals have been one of the foundations of progress in international&nbsp;criminal law. The two legal institutions that were established with the breakdown of the bipolar world order during the Cold War took these efforts further by adding new elements to their statutes that aimed to prosecute war criminals and prevent the commission of further unlawful acts. The International Criminal Tribunals for the former Yugoslavia and for Rwanda participated in attempts to improve the scope of the codification of international crimes and thus arrived at an interpretation that was more up-to-date and appropriate to the context of the era.&nbsp;Is it possible to establish a direct link between Kantian cosmopolitan law and these historical developments? Does this evolution prove the rooting of the principles of a universal human society within the discipline of international law? Kantian cosmopolitanism discusses the possibility of gradually creating a political, legal, and social framework that begins at the state level and extends to world citizenship. According to Kant, such cosmopolitanism is a way to ensure perpetual peace. The legal aspect of this thought led to the ideal of the creation of a cosmopolitan law for issues that concern humanity as a whole. Cosmopolitan law aims to find solutions to global problems such as the violation of fundamental rights of individuals and environmental issues, as this juridical sphere recommends the construction of universal legal norms that complement national and international law. It underlines the universalisation of humanitarian legal society.&nbsp;This research aims to determine the link between certain historical developments of the 20th century and Kant’s concept of cosmopolitan law. It intends to demonstrate that the motivation behind the establishment of ad hoc tribunals is strongly linked to this approach. Within this perspective, the first part is dedicated to a theoretical examination of Kantian cosmopolitan law and two models by Olivier de Frouville that interpret this universalisation within the scope of international law. In this research, the step towards the cosmopolitanising of international law is observed from a fundamental right perspective. The historical period to be examined is the second half of the 20th century. In the second part, which includes an empirical study, four ad hoc criminal tribunals created during this period will be analysed to obtain concrete elements that demonstrate a connection with cosmopolitan law. Hence, this article demonstrates that four ad hoc tribunals contributed to the codification of international crimes and thus supported the implementation of the principles of cosmopolitan law. This research will contribute to international relations and international law.

The role of ad hoc tribunals in the implementation of cosmopolitan law: an empirical  study via Kantian ethics

Mauritius has, for historical reasons, a mixed legal system, where one part is influenced by the Common Law and the other is inspired by French law. The organisation of the courts of justice in Mauritius is based on the UK model, and the powers of the Supreme Court of Mauritius are the same as those of the High Court of Justice in England. Many branches of the Mauritian Law, maritime law, and judicial review, for example, have been influenced by the Common Law, but some parts of it, the Civil Code, for instance, are of French origin. This is because the Act of capitulation signed between France and the United Kingdom in 1810 has authorised the inhabitants of the island to keep their laws. In these circumstances, a comparison between French and Mauritian civil law is well justified.&nbsp;&nbsp;Both France and Mauritius have special rules on tort liability for acts committed by minors. These rules concern public schools, teaching staff, and parents. However, Mauritian Law differentiates from French Law regarding the existence of a general principle of tort liability for the acts of others (children). In France, such a general principle was established in the case of Blieck brought before the French Court of Cassation. In Mauritius, such a general principle does not exist, meaning that the victim of harm must rely on the general rules on subjective tort liability and prove the fault of the defendant.&nbsp;&nbsp;A comparison between France and Mauritius leads us to the conclusion that a general regime of tort liability may exist for the acts of minor children in Mauritius. Two conditions need to be fulfilled for the application of the aforesaid general regime: (1) the existence of legal power exercised over a child and (2) the existence of the personal liability of a child. This liability may be subjective, based on the civil fault of a child, or objective, without any civil fault of the child.It is certain that tort liability for the acts of a minor child derogates from the general rule in Mauritius that the victim of harm must prove the civil fault of the defendant. Thus, a general regime of tort liability for the acts of a minor child may be based either on the presumption of a civil fault of the person exercising the legal power over a child or objectively without any fault. On the one hand, objective liability, which is harsh on the liable person, needs to be applied only if the benefit realised by the liable person and the situation of the liable person justify such a legal solution. On the other hand, in all other situations, the liability for the acts of a minor child must be based on the presumption of civil negligence. This gives the liable person the opportunity to escape from his or her liability by proving that no civil fault has been committed. It is not necessary to prove the existence of a force majeure.

The jurisprudence of the European Court of Human Rights bears a certain relevance to the national legal systems of the member states of the Council of Europe. Many decisions of the European Court of Human Rights pertain to the freedom of association of civil servants. In particular, the Grand Chamber’s decision of “Demir Baykara” is considered to be a cornerstone in this area. The Grand Chamber has decided in this case that the freedom of association under Article 11 of the European Convention on Human Rights includes the right to form a trade union and become a member of a trade union. It has been observed that Turkey is a party to many disputes brought before the European Court of Human Rights regarding the freedom of association of civil servants. The cases are related to the forming of unions, the temporary work stoppage of civil servants and the effective exercise of the right to freedom of assembly and association in the civil service. This study gives a brief overview of some decisions of the European Court of Human Rights in which the Court held that Turkey violated “the right to freedom of assembly and association” under Article 11 of the European Convention on Human Rights.&nbsp;In Turkish law, numerous legislative changes, including amendments to the Constitution, have taken place in recent years. The restrictions on freedom of association have been abolished step by step. The abolishment of the restrictions on&nbsp;freedom of association was initiated by individual efforts of citizens and trade unions in the civil service. In accordance with legal developments, trade union confederations can conclude collective agreements in the civil service, but their members are not allowed to strike. A right to strike is a foreign term to the Law on Trade Unions and Collective Agreements of Civil Servants No.4688. If the parties cannot agree upon and conclude a collective agreement, they must apply to the Arbitration Committee of Civil Servants and a protocol must be submitted thereto. The agreement concluded after negotiation with the Arbitration Committee of Civil Servants is binding as a collective agreement. Therefore, the Law on Trade Unions and Collective Agreements of Civil Servants No.4688, as well as the relevant legislation, needs to be revised. This need for reform has long been emphasized in the academic literature. This study outlines recent important legal developments regarding the right of civil servants to organize and to bargain collectively in Turkey.&nbsp;freedom of association was initiated by individual efforts of citizens and trade unions in the civil service. Although the penalty clause is included in many contracts in practice today, it contains several controversial issues that are still waiting to be resolved both in the doctrine and in judicial decisions. One of these issues is the consequence of the penalty clause in the event of the transfer of receivables or in case the debt is assumed.&nbsp;The penalty clause is a provision requiring financial compensation, which is promised to be paid to the other party in the event of the contract is being breached, either partially or fully. In Turkish Law, the penalty clause is regulated in Article 179 and in the following sections of the Turkish Code of Obligations number 6098. The penalty clause appears as a debt in connection with the principal debt. The emergence, continuity and termination of the penalty clause depends on the existence of the principal debt. The transfer of the receivable is regulated between Articles 183 and 194 of the Turkish Code of Obligations number 6098. Because of its accessory nature the penalty clause has significant consequences. One of these is the transfer of authority to demand a penalty clause of the new owner of the receivable in the event of the transfer of the said receivable. The Swiss and German doctrines have for many years placed an emphasis on the transfer of the receivable within the framework of the penalty clause. In this context, however, there are no obvious regulations in Turkish Law. Thus, many different views have arisen on the matter. The focus is set on whether the penalty clause can be transferred independently of the principal receivable. Moreover, many different opinions have also emerged about which creditor has the right to demand a penalty clause. The issue is generally handled depending on whether the penalty clause is due. Our present study focuses specifically on this latter detail.&nbsp;In the event of the transfer of the principal receivable, the penalty clause which is not yet due will also be transferred to the transferee together with the principal receivable. The matter of transferring the penalty clause to a third party independently of the principal receivable before it is due is controversial. After the penalty clause is due, the principal-accessory debt relationship with the principal debt disappears. In this case, since the penalty clause turns into an independent receivable, the penalty clause does not have to pass onto the transferee when the principal receivable is transferred. In the event of the transfer of the receivable, a distinction should be made taking into account the general principles regarding whether the penalty clause can be transferred independently before or after it is due. Therefore, before the penalty clause is due, an interpretation should be made by paying attention to the fact that it has the accessory nature. In our study, our opinion on the controversial issues is explained in detail within the boundaries of this interpretation.Turkish Code of Obligations number 6098. If the debt is assumed, the accessory nature of the penalty clause comes to the fore regarding the status of the penalty clause. According to Article 198/1 of the TBK, the rights of the creditor other than those related to the personality of the debtor will be reserved even if the debtor has changed. This conclusion does not raise any doubt that the person who assumes the debt will be liable if the penalty clause is due after the debt is assumed. An important issue to address in terms of assuming the debt is whether or not it is possible for a third-party to assume the penalty clause, which has not been due yet, independently of the principal debt. Also, an interpretation should be made by paying attention to the accessory nature of the penalty clause in the controversial areas previously mentioned about assuming the debt. Before the penalty clause is due, it is not possible to independently assume this due to the accessory nature of the penalty clause. On the other hand, the penalty clause continues its existence as an independent debt after it is due. In this case, it is possible to assume it separately from the principal debt. In our study, an attempt was made to find a solution to the controversial issues on assuming debt by taking the German and Swiss Laws into account.It should be noted that an interpretation should be made without forgetting that the penalty clause is an accessory debt if the receivable is transferred or the debt is assumed. When this method is pursued, it will be possible to obtain consistent results in terms of the effect of the transferred receivable or assumed debt on both the penalty clause which is due and the penalty clause which has not been due yet.In our study, the accessory nature of the penalty clause will first be discussed. Then, the opinions put forward on the subject in the Turkish, Swiss and German doctrines will be included. And finally, we will state our opinion focusing on the accessory nature of the penalty clause on the controversial issues.

Annales de la Faculte de Droit d’Istanbul has been an open access, peer-reviewed, scholarly journal published by İstanbul University, Faculty of Law. since 1951. As of the year 2023, it has started to be published two times a year, these publication months being March and September. The journal aims to publish high quality articles and thus contribute to the accumulation and dissemination of knowledge in the field. 
The journal is a well-known and long-standing peer-reviewed academic journal that reviews the latest evolutions in and developments in the legal field since 1951. The approach of the Journal is a comparative one and accordingly will focus on not only Turkish domestic law but also German, Swiss, French, European Union and Anglo-American laws as well as all fields of international law. It embraces work that is theoretical, empirical, socio-legal, doctrinal or comparative that relates to any legal systems. Each edition of the Annales contains significant theoretical contributions while also being a dossier of information on the cross-cultural application of a specific area of law. Annales also publishes both translated texts of Turkish relevant legislation. It is worth noting that Turkey becomes very important actor in the process of enlargement of EU and the regional leader in the Middle East and Asia Minor. Annales is the leading forum for research and discussion of the law and legal systems of these regions. Thus, the Annales with its Editorial Board including both national and international leading experts is the magnet for all legal scholars working in this region.

Orijinal, yayınlanmamış ve başka bir dergide değerlendirme sürecinde olmayan, her bir yazar tarafından içeriği ve gönderimi onaylanmış yazılar değerlendirmeye kabul edilir.Makale yayınlanmak üzere Dergiye gönderildikten sonra yazarlardan hiçbirinin ismi, tüm yazarların yazılı izni olmadan yazar listesinden silinemez ve yeni bir isim yazar olarak eklenemez ve yazar sırası değiştirilemez.İntihal, duplikasyon, sahte yazarlık/inkar edilen yazarlık, araştrma/veri fabrikasyonu, makale dilimleme, dilimleyerek yayın, telif hakları ihlali ve çıkar çatışmasının gizlenmesi, etik dışı davranışlar olarak kabul edilir. Kabul edilen etik standartlara uygun olmayan tüm makaleler yayından çıkarılır. Buna yayından sonra tespit edilen olası kuraldışı, uygunsuzluklar içeren makaleler de dahildir.İntihalÖn kontrolden geçirilen makaleler, iThenticate yazılımı kullanılarak intihal için taranır. İntihal/kendi kendine intihal tespit edilirse yazarlar bilgilendirilir. Editörler, gerekli olması halinde makaleyi değerlendirme ya da üretim sürecinin çeşitli aşamalarında intihal kontrolüne tabi tutabilirler. Yüksek benzerlik oranları, bir makalenin kabul edilmeden önce ve hatta kabul edildikten sonra reddedilmesine neden olabilir. Makalenin türüne bağlı olarak, bunun oranın %15 veya %20'den az olması beklenir.Çift Kör Hakemlikİntihal kontrolünden sonra, uygun olan makaleler baş editör tarafından orijinallik, metodoloji, işlenen konunun önemi ve dergi kapsamı ile uyumluluğu açısından değerlendirilir. Editör, makalelerin adil bir şekilde çift taraflı kör hakemlikten geçmesini sağlar ve makale biçimsel esaslara uygun ise, gelen yazıyı yurtiçinden ve /veya yurtdışından en az iki hakemin değerlendirmesine sunar, hakemler gerek gördüğü takdirde yazıda istenen değişiklikler yazarlar tarafından yapıldıktan sonra yayınlanmasına onay verir.

Politikalar

Dergi açık erişimlidir ve derginin tüm içeriği okura ya da okurun dahil olduğu kuruma ücretsiz olarak sunulur. Okurlar, ticari amaç haricinde, yayıncı ya da yazardan izin almadan dergi makalelerinin tam metnini okuyabilir, indirebilir, kopyalayabilir, arayabilir ve link sağlayabilir. Bu <a href="https://www.budapestopenaccessinitiative.org/translations/turkish-translation" target="_blank">BOAI</a> açık erişim tanımıyla uyumludur.Derginin açık erişimli makaleleri Creative Commons Atıf-GayrıTicari 4.0 Uluslararası (<a href="https://creativecommons.org/licenses/by-nc/4.0/deed.tr" target="_blank">CC BY-NC 4.0</a>) olarak lisanslıdır.

Derginin tüm giderleri İstanbul Üniversitesi tarafından karşılanmaktadır. Dergide makale yayını ve makale süreçlerinin yürütülmesi ücrete tabi değildir. Dergiye gönderilen ya da yayın için kabul edilen makaleler için işlemleme ücreti ya da gönderim ücreti alınmaz.

Yazarlar dergide yayınlanan çalışmalarının telif hakkına sahiptirler ve çalışmaları  Creative Commons Atıf-GayrıTicari 4.0 Uluslararası (<a href="https://creativecommons.org/licenses/by-nc/4.0/deed.tr" target="_blank">CC BY-NC 4.0</a>) olarak lisanslıdır. CC BY-NC 4.0 lisansı, eserin ticari kullanım dışında her boyut ve formatta paylaşılmasına, kopyalanmasına, çoğaltılmasına ve orijinal esere uygun şekilde atıfta bulunmak kaydıyla yeniden düzenleme, dönüştürme ve eserin üzerine inşa etme dâhil adapte edilmesine izin verir.

Editörler, yayınlanan makalede, bulguları, yorumları ve sonuçları etkilemeyen küçük hatalar tespit edilirse düzeltme yayınlamayı düşünebilirler. Editörler, bulguları ve sonuçları geçersiz kılan büyük hatalar / ihlaller söz konusu olduğunda, makaleyi geri çekmeyi düşünmelidir. Yazarlar tarafından araştırma veya yayını kötüye kullanmaya yönelik olasılık söz konusu ise; bulguların güvenilir olmadığına ve yazarların kurumlarının olayı soruşturmadığına dair kanıtlar var veya olası soruşturma haksız veya sonuçsuz görünüyor ise, editörler endişe ifadesi yayınlamayı düşünmelidir. Düzeltme, geri çekme veya endişe ifadesi ile ilgili olarak <a href="https://publicationethics.org/resources/flowcharts/complete-set-english" target="_blank">COPE</a> ve <a href="https://www.icmje.org/recommendations/" target="_blank">ICJME</a> yönergeleri dikkate alınır.Geri ÇekmeDergi geri çekme durumunda <a href="https://publicationethics.org/sites/default/files/retraction-guidelines-cope.pdf" target="_blank">COPE Retraction Guidelines</a>’ı izler. Geri çekme bildirimi  içindekiler tablosunda sayfa nosu verilerek listelenir. </li><li>Elektronik versiyonda geri çekme bildirimi ile orijinal makale arasında link sağlanır. </li><li>Online makaleden önce geri çekme bildirimini içeren sayfa gelir; okuyucu daha sonra makalenin kendisine geçebilir.</li><li>Orijinal makale, her sayfadaki .pdf üzerinde “geri çekildiğini” belirten bir filigran dışında değişmeden kalır.</li></ul>Yasal Nedenlerle Makalenin KaldırılmasıAşağıdaki durumlarda, üst veriler (başlık ve yazarlar) hariç olmak üzere, makale metni kaldırılır ve makalenin yasal nedenlerle kaldırıldığını bildiren bir sayfa makalenin yerini alır. <ul><li>Makalenin karalayıcı içerik ihtiva ettiği veya başkalarının yasal haklarını ihlal ettiği tespit edilir ve geri çekmenin yeterli bir çözüm olmadığı düşünülürse;</li><li>Makale bir mahkeme kararına konu olmuşsa veya olacağına dair makul bir neden varsa;</li><li>Kamu sağlığı açısından önemli bir risk söz konusu ise;  </li></ul>

Dergide yayınlanan tüm yazıların korunmasını ve kalıcı olarak erişilebilir olmasını sağlamak için makaleler, ulusal bir arşiv sitesi olarak hizmet veren ve aynı zamanda LOCKSS'in içeriği toplamasına, korumasına ve sunmasına izin veren Dergipark'ta saklanmaktadır.Ek olarak, yazarların kendilerinin makalelerinin son PDF sürümünü Open Archives Initiative (<a href="https://www.openarchives.org/" target="_blank">https://www.openarchives.org/</a>) standartlarına uygun açık elektronik arşivlerde arşivlemeleri önerilir. Yazarlar, yayınladıkları arşiv versiyonundan, İ.Ü. Yayınevinin dergi web sitesinin URL'sine bağlantı sağlamalıdır.

İntihal, duplikasyon, sahte yazarlık/inkar edilen yazarlık, araştrma/veri fabrikasyonu, makale dilimleme, dilimleyerek yayın, telif hakları ihlali ve çıkar çatışmasının gizlenmesi, etik dışı davranışlar olarak kabul edilir.Kabul edilen etik standartlara uygun olmayan tüm makaleler yayından çıkarılır. Buna yayından sonra tespit edilen olası kuraldışı, uygunsuzluklar içeren makaleler de dahildir. Dergi, şüpheli başvurular, suistimal ve şikayetler ile karşı karşıya kaldığında COPE'nin ilişkili akış şemalarına ve yönergelerine uygun hareket edecektir.

Etik

Dergi araştırma etiğinde en yüksek standartları gözetir ve aşağıda tanımlanan uluslararası araştırma etiği ilkelerini benimser. Makalelerin etik kurallara uygunluğu yazarların sorumluluğundadır.- Araştırmanın tasarlanması, tasarımın gözden geçirilmesi ve araştırmanın yürütülmesinde, bütünlük, kalite ve şeffaflık ilkeleri sağlanmalıdır.- Araştırma ekibi ve katılımcılar, araştırmanın amacı, yöntemleri ve öngörülen olası kullanımları; araştırmaya katılımın gerektirdikleri ve varsa riskleri hakkında tam olarak bilgilendirilmelidir.- Araştırma katılımcılarının sağladığı bilgilerin gizliliği ve yanıt verenlerin gizliliği sağlanmalıdır. Araştırma katılımcıların özerkliğini ve saygınlığını koruyacak şekilde tasarlanmalıdır.- Araştırma katılımcıları gönüllü olarak araştırmada yer almalı, herhangi bir zorlama altında olmamalıdırlar.- Katılımcıların zarar görmesinden kaçınılmalıdır. Araştırma, katılımcıları riske sokmayacak şekilde planlanmalıdır.- Araştırma bağımsızlığıyla ilgili açık ve net olunmalı; çıkar çatışması varsa belirtilmelidir.- Deneysel çalışmalarda, araştırmaya katılmaya karar veren katılımcıların yazılı bilgilendirilmiş onayı alınmalıdır. Çocukların ve vesayet altındakilerin veya tasdiklenmiş akıl hastalığı bulunanların yasal vasisinin onayı alınmalıdır.- Çalışma herhangi bir kurum ya da kuruluşta gerçekleştirilecekse bu kurum ya da kuruluştan çalışma yapılacağına dair onay alınmalıdır.- İnsan öğesi bulunan çalışmalarda, “yöntem” bölümünde katılımcılardan “bilgilendirilmiş onam” alındığının ve çalışmanın yapıldığı kurumdan etik kurul onayı alındığı belirtilmesi gerekir.

Makalelerin bilimsel ve etik kurallara uygunluğu yazarların sorumluluğundadır. Yazar makalenin orijinal olduğu, daha önce başka bir yerde yayınlanmadığı ve başka bir yerde, başka bir dilde yayınlanmak üzere değerlendirmede olmadığı konusunda teminat sağlamalıdır. Uygulamadaki telif kanunları ve anlaşmaları gözetilmelidir. Telife bağlı materyaller (örneğin tablolar, şekiller veya büyük alıntılar) gerekli izin ve teşekkürle kullanılmalıdır. Başka yazarların, katkıda bulunanların çalışmaları ya da yararlanılan kaynaklar uygun biçimde kullanılmalı ve referanslarda belirtilmelidir.Gönderilen makalede tüm yazarların akademik ve bilimsel olarak doğrudan katkısı olmalıdır, bu bağlamda “yazar” yayınlanan bir araştırmanın kavramsallaştırılmasına ve dizaynına, verilerin elde edilmesine, analizine ya da yorumlanmasına belirgin katkı yapan, yazının yazılması ya da bunun içerik açısından eleştirel biçimde gözden geçirilmesinde görev yapan birisi olarak görülür. Yazar olabilmenin diğer koşulları ise, makaledeki çalışmayı planlamak veya icra etmek ve / veya revize etmektir. Fon sağlanması, veri toplanması ya da araştırma grubunun genel süpervizyonu tek başına yazarlık hakkı kazandırmaz. Yazar olarak gösterilen tüm bireyler sayılan tüm ölçütleri karşılamalıdır ve yukarıdaki ölçütleri karşılayan her birey yazar olarak gösterilebilir. Yazarların isim sıralaması ortak verilen bir karar olmalıdır. Tüm yazarlar yazar sıralamasını <a href="https://cdn.istanbul.edu.tr/file/JTA6CLJ8T5/A210D21E5AF8458AB8893966D5E58CE9" target="_blank">Telif Hakkı Anlaşması Formu'nda</a> imzalı olarak belirtmek zorundadırlar.Yazarlık için yeterli ölçütleri karşılamayan ancak çalışmaya katkısı olan tüm bireyler “teşekkür / bilgiler” kısmında sıralanmalıdır. Bunlara örnek olarak ise sadece teknik destek sağlayan, yazıma yardımcı olan ya da sadece genel bir destek sağlayan, finansal ve materyal desteği sunan kişiler verilebilir.Bütün yazarlar, araştırmanın sonuçlarını ya da bilimsel değerlendirmeyi etkileyebilme potansiyeli olan finansal ilişkiler, çıkar çatışması ve çıkar rekabetini beyan etmelidirler. Bir yazar kendi yayınlanmış yazısında belirgin bir hata ya da yanlışlık tespit ederse, bu yanlışlıklara ilişkin düzeltme ya da geri çekme için editör ile hemen temasa geçme ve işbirliği yapma sorumluluğunu taşır.

Baş editör, makaleleri, yazarların etnik kökeninden, cinsiyetinden, cinsel yöneliminden, uyruğundan, dini inancından ve siyasi felsefesinden bağımsız olarak değerlendirir. Yayına gönderilen makalelerin adil bir şekilde çift taraflı kör hakem değerlendirmesinden geçmelerini sağlar. Gönderilen makalelere ilişkin tüm bilginin, makale yayınlanana kadar gizli kalacağını garanti eder. Baş editör içerik ve yayının toplam kalitesinden sorumludur. Gereğinde hata sayfası yayınlamalı ya da düzeltme yapmalıdır.Baş editör; yazarlar, editörler ve hakemler arasında çıkar çatışmasına izin vermez. Hakem atama konusunda tam yetkiye sahiptir ve Dergide yayınlanacak makalelerle ilgili nihai kararı vermekle yükümlüdür.Hakemlerin araştırmayla ilgili, yazarlarla ve/veya araştırmanın finansal destekçileriyle çıkar çatışmaları olmamalıdır. Değerlendirmelerinin sonucunda tarafsız bir yargıya varmalıdırlar. Gönderilmiş yazılara ilişkin tüm bilginin gizli tutulmasını sağlamalı ve yazar tarafında herhangi bir telif hakkı ihlali ve intihal fark ederlerse editöre raporlamalıdırlar. Hakem, makale konusu hakkında kendini vasıflı hissetmiyor ya da zamanında geri dönüş sağlaması mümkün görünmüyorsa, editöre bu durumu bildirmeli ve hakem sürecine kendisini dahil etmemesini istemelidir.Değerlendirme sürecinde editör hakemlere gözden geçirme için gönderilen makalelerin, yazarların özel mülkü olduğunu ve bunun imtiyazlı bir iletişim olduğunu açıkça belirtir. Hakemler ve yayın kurulu üyeleri başka kişilerle makaleleri tartışamazlar. Hakemlerin kimliğinin gizli kalmasına özen gösterilmelidir. Bazı durumlarda editörün kararıyla, ilgili hakemlerin makaleye ait yorumları aynı makaleyi yorumlayan diğer hakemlere gönderilerek hakemlerin bu süreçte aydınlatılması sağlanabilir.

Daha önce yayınlanmamış ya da yayınlanmak üzere başka bir dergide halen değerlendirmede olmayan ve her bir yazar tarafından onaylanan makaleler değerlendirilmek üzere kabul edilir. Gönderilen ve ön kontrolü geçen makaleler iThenticate yazılımı kullanılarak intihal için taranır. İntihal kontrolünden sonra, uygun olan makaleler baş editör tarafından orijinallik, metodoloji, işlenen konunun önemi ve dergi kapsamı ile uyumluluğu açısından değerlendirilir.Seçilen makaleler en az iki ulusal/uluslararası hakeme çift taraflı kör hakemlik ile değerlendirmeye gönderilir; yayın kararı, hakemlerin talepleri doğrultusunda yazarların gerçekleştirdiği düzenlemelerin ve hakem sürecinin sonrasında baş editör tarafından verilir.

DilDerginin yayın dili İngilizce, Almanca ve Fransızca’dır.Yazıların Hazırlanması ve Gönderimi Aksi belirtilmedikçe gönderilen yazılarla ilgili tüm yazışmalar ilk yazarla yapılacaktır. Makale gönderimi online olarak ve <a href="https://dergipark.org.tr/tr/pub/ppil" target="_blank">https://dergipark.org.tr/tr/pub/ppil</a> üzerinden yapılmalıdır. Gönderilen yazılar, yazının yayınlanmak üzere gönderildiğini ifade eden, makale türünü belirten ve makaleyle ilgili bilgileri içeren (bkz: Son Kontrol Listesi) bir mektup; yazının elektronik formunu içeren Microsoft Word 2003 ve üzerindeki versiyonları ile yazılmış elektronik dosya ve tüm yazarların imzaladığı <a href="https://cdn.istanbul.edu.tr/file/JTA6CLJ8T5/28F87D94BF834DD1884FCD0AA8F7BD11" target="_blank">Telif Hakkı Anlaşması Formu</a> eklenerek gönderilmelidir. 1. Çalışmalar, A4 boyutundaki kağıdın bir yüzüne, üst, alt, sağ ve sol taraftan 2,5 cm. boşluk bırakılarak, 12 punto Times New Roman harf karakterleriyle ve 1,5 satır aralık ölçüsü ile hazılarlanmalıdır. 2. Yazar/yazarların adları çalışmanın başlığının hemen altında sağa bitişik şekilde verilmelidir. Ayrıca yıldız dipnot şeklinde (*) yazarın unvanı, kurumu ve e-posta adresi ve telefonu sayfanın en altında dipnotta belirtilmelidir.3. Dergimize gönderilen makalelerde Giriş bölümünden önce 200-250 kelime arasında çalışmanın kapsamını, amacını, ulaşılan sonuçları ve kullanılan yöntemi kaydeden makale dilinde ve İngilizce öz (abstract) ile çalışmanın içeriğini temsil eden 5-15 makale dilinde ve İngilizce anahtar kelime yer almalıdır. Fransızca ve Almanca makalelerde, 800-1000 kelime içeren İngilizce genişletilmiş özet (extended summary) yer almalıdır.4. Çalışmaların başlıca şu unsurları içermesi gerekmektedir: Başlık, makale dilinde öz ve anahtar kelimeler; İngilizce başlık, İngilizce öz ve anahtar kelimeler; Fransızca ve Almanca makalelerde yazar tarafından ileri sürülen görüşleri ve varılan sonuçları kapsayacak mahiyette 800-1000 kelime genişletilmiş özet, ana metin bölümleri, son notlar ve kaynaklar.5. Metin içi alıntılama ve kaynak gösterme için OSCOLA kaynak sitilinin 4. versiyonu kullanılmalıdır. OSCOLA 4 stili hakkında bilgi için; http://annales.istanbul.edu.tr/tr/content/yazarlara-bilgi/kaynaklar sayfasını ziyaret edebilir veya Yazarlara Bilgi’nin Kaynaklar başlığı altında ilgili açıklama ve örnekleri inceleyebilirsiniz.6. Çalışmalarda tablo, grafik ve şekil gibi göstergeler ancak çalışmanın takip edilebilmesi açısından gereklilik arz ettiği durumlarda, numaralandırılarak, tanımlayıcı bir başlık ile birlikte verilmelidir. Tablolara ait başlık üstte, Şekiller’e ait başlık altta yer almalıdır. Demografik özellikler gibi metin içinde verilebilecek veriler, ayrıca tablolar ile ifade edilmemelidir.7. Yayınlanmak üzere gönderilen makale ile birlikte yazar bilgilerini içeren <a href="https://cdn.istanbul.edu.tr/file/JTA6CLJ8T5/3C208FBA6C1740D1B3A57740D70E4D29" target="_blank">kapak sayfası</a> gönderilmelidir. Kapak sayfasında, makalenin başlığı, yazar veya yazarların bağlı bulundukları kurum ve unvanları, kendilerine ulaşılabilecek adresler, cep, iş ve faks numaraları ve e-posta adresleri yer almalıdır (bkz. Son Kontrol Listesi).8. Kurallar dâhilinde dergimize yayınlanmak üzere gönderilen çalışmaların her türlü sorumluluğu yazar/yazarlarına aittir.9. Yayın kurulu ve hakem raporları doğrultusunda yazarlardan, metin üzerinde bazı düzeltmeler yapmaları istenebilir.10. Yayınlanmasına karar verilen çalışmaların, yazar/yazarlarının her birine dergi gönderilir.11. Dergiye gönderilen çalışmalar yayınlansın veya yayınlanmasın geri gönderilmez.
