Applying the Principle of Best Interests to the Hague Convention on the Civil Aspects of International Child Abduction in Light of the Decisions of the European Court of Human Rights and of Turkish Courts

The Hague Convention on the Civil Aspects of International Child Abduction was signed on October 25, 1980 with the aim of preventing the “wrongful removal or retention [of children under 16 years of age] and to establish procedures to ensure their prompt return to the State of their habitual residence.” Decisions regarding the return of a child are considered temporary and procedural, while decisions regarding custody rights are left to the courts of habitual residence. The convention states a limited number of grounds for refusal to return, and the best interest of the child does not occur among these. Despite its absence, the convention operates on the assumption that a prompt return is in children’s best interests, with exceptions being provided under certain limited circumstances so as to secure the child’s best interests under these exceptional situations. The convention is considered to be closely tied to Article 8 of the European Convention on Human Rights (ECHR, 1953), as it regulates children’s relationships with their parents. Therefore, the convention and Article 8 of ECHR are applied together in the decisions of the European Court of Human Rights. The convention and Article 8 of ECHR have been interpreted harmoniously in some decisions, while the Court has also conducted a separate and extensive best interest principal analysis for other decisions. This paper will analyze the best interest principle in the context of the convention and in light of the decisions of the European Court of Human Rights and of Turkish court..

(Avrupa İnsan Hakları Mahkemesi ve Türk Yargı Kararları Işığında) 1980 Tarihli Uluslararası Çocuk Kaçırmanın Hukuki Yönlerine Dair Lahey Sözleşmesi’nin Uygulanmasında Çocuğun Üstün Yararı

1980 Tarihli Uluslararası Çocuk Kaçırmanın Hukuki Veçheleri Hakkında Sözleşme, mutad meskeni akit bir devlette bulunan ve velayet hakkı ihlâl edilerek başka bir akit devlete kaçırılarak götürülen veya alıkonulan ve 16 yaşını henüz tamamlamamış çocuğun mutad meskenine derhal iadesini sağlamayı amaçlamaktadır. İade kararı, velayete ilişkin karar verilinceye kadar olan geçici bir dönemi düzenleyen, usûli bir karar olarak öngörülmüş olup velayet hakkına ilişkin kararın, bu konuda daha yetkin olduğu kabul edilen mutad mesken mahkemesi tarafından verilmesi tercih edilmiştir. Sözleşme’de, derhal iade amacı gözetilerek sınırlı sayıda iade ret sebebine yer verilmiştir ve çocuğun üstün yararı ilkesi sayılan bu iade ret sebepleri arasında yer almamaktadır. Ancak bu noksanlık Sözleşme kapsamında çocuğun üstün yararı ilkesinin gözetilmediği anlamına da gelmemektedir; derhal iade ve iadenin yaratabileceği risklerin bertaraf edilebilmesi amacıyla yer verilen iade retsebepleriyle bu ilkenin temin edildiği kabul edilmektedir. Çocuğun, ebeveynleriyle ilişkilerini düzenlemesi açısından Sözleşme, Avrupa İnsan Hakları Sözleşmesi m. 8’de yer alan ‘aile hayatına saygı hakkı’yla yakından bağlantılıdır. Belirtilen nedenle, Avrupa İnsan Hakları Mahkemesi kararlarında, Sözleşme ve aile hayatına saygı hakkı beraber yorumlanmaktadır. Kararların belirli bir kısmında Sözleşme ve m. 8 uyumlu bir şekilde yorumlanıp uygulanırken, bir kısmında Sözleşme’deki derhal iade ilkesi göz ardı edilerek çocuğun üstün yararına ilişkin ayrıntılı ve müstakil bir değerlendirme yapılmaktadır. Çalışmamızda, Lahey Sözleşmesi bağlamında çocuğun üstün yararı ilkesi öncelikle Avrupa İnsan Hakları Mahkemesi kararlarında ışığında ele alınmakta ve daha sonra söz konusu ilkenin Türk mahkeme kararlarındaki yeri ortaya konmaya çalışılmaktadır.
